They are cakes, and that's been proven in UK court - if I remember the story correctly, in UK they have tax on chocolate biscuits, but not cakes - so that was a case, and Jaffa won.

@Player1x3 - that's the only right way to eat them, as all Jaffa cakes admirers know. ;)
