What I mean is some places do urine/hair tests to see if you have smoked in the last few days/weeks.  Could employers still deny employment if you don't pass a test saying you have done a legal drug a few weeks ago?

This is the problem. Employers need a way to determine whether or not you are currently under the influence -- otherwise they have no way to differentiate between people who smoke on their own time and people who smoke right before work. I don't know whether or not such a method exists, but if it does not or is more expensive, I expect the law to continue to allow employers to deny employment to people who 'fail' drug tests.
