You can't show up to work drunk, but if you wanna get tore up over the weekend that's your business. This is the problem. Employers need a way to determine whether or not you are currently under the influence -- otherwise they have no way to differentiate between people who smoke on their own time and people who smoke right before work. I don't know whether or not such a method exists, but if it does not or is more expensive, I expect the law to continue to allow employers to deny employment to people who 'fail' drug tests.
