Isn't Banjo property of RARE? obviously MS owns them so they own what RARE owns, but if Nintendo buys it from MS, wouldn't it become property of Nintendo by the same principal that made it property of MS years ago?

Nah, Microsoft owns the IP, so it's possible Nintendo could buy the IP woithout touching Rare. If they do get the IP, they might as well get Rare's other dormant IP like Killer Instinct and Conker. Conker and the gang could be in the next Smash bros which would be a big plus. 

As for Rare itself, Microsoft has other studios working on Kinect games, so they could probably them of and not lose much given there isn't much at Rare anyway. Today's Rare could flourish likethey did in their heyday if they have the proper guidance, but Nintendo would have to pay a lot, more than they're probably willing to.
