Isn't Banjo property of RARE? obviously MS owns them so they own what RARE owns, but if Nintendo buys it from MS, wouldn't it become property of Nintendo by the same principal that made it property of MS years ago?

Yes. But I doubt MS is selling. Nintendo has been on record stating that they are taking it easy on paying money for exclusives and acquisitions.
