But that isn't going to happen, that's like saying it's a very real possibility it will be cold tomorrow if the sun vanishes from the sky. The important bit is how likely MS won't settle and how likely it will be cold tomorrow because there is no sun. By using the "if this happens then that happens" sentence structure it takes away the actual calculation of what might or might not happen and is deceptive in language. (not that you were trying to, I'm not implying that).

The question is not, "How likely is it that the Xbox 360 will be banned from sale?", the real question is "How likely is it that MS won't settle before that will happen?".

Same question, but I suspect hardly anyone will answer negative to the second, whereas a fair few intelligent people who aren't thinking a bit deeper will actually answer positive to the first.

Motorola's demands are completely unreasonable to expect the return they are on their patent and any judge will agree with that and simply award a much lower figure - if it goes that far - which it won't. It will be hammered out and an agreement made at the 11th hour as that's how these things work in my opinion.
