Presumably MS sided with H.264 before Google decided to buy Motorola to leverage themselves against forthcoming litigation against MS infringements.

Is this the first time G/M have chased anyone for compensation for using this? They must be licking their lips thinking that if this passes they can chase Sony, Nintendo, Apple, Samsung etc. and then all the streaming services I assume would be liable as well e.g. Netflix. 

No, Apple and Motorola have also locked horns on the same issue.  Motorola is attempting to license a FRAND patent at 2.25% of the unit price, rather than at a nominal per unit price because Apple requested they license patents that they own.
