I agree with the intention behind the case but disagree with the result ...
If you buy a game that has a particular rating, then there should be no unlockable content that is beyond the rating. The problem with the Hot Coffee mod is that it was not accessable in the version that was released, and you had to download a mod to see the questionable content; the difference between downloading this mod and downloading a user created mod is (in my opinion) very minimal, and developers should not be held accountable for content they did not intend people to have access to.
