well, I'm not a lawer, but I guess it technically is banned, but that won't be enforced until the law suit in US is decided (and the appeal suit and so on)

from what I understood there was a verdict that Motorola couldn't start this law suit in germany prior to it .. and well they did it anyway

but whatever, the situation is pretty complicated ;) and in the end there won't be any effect on us consumers anyway

but since it's all about money i don't think they will do that
