Both Microsoft and Motorola each won victories in the ITC.  However, there is a separate case still pending regarding another set of patents.

Motorola's two cases involve Wi-FI and H.264.  In the US, it appears the recommendation will be to ban the import and sale of the Xbox 360 S because it violates the Wi-Fi patents.  A preliminary decision was found Microsoft also in violate of the H.264 patents, however Microsoft is arguing that Motorola isn't licensing its patents fairly, reasonable and nondiscriminatorily as they agreed to do.

Microsoft won it's case against Motorola involving one of its patents, which has resulted in a ban on the import and sale of specific Motorola phones.

Both companies will likely appeal any cases they didn't win.  Since both companies are capable of paying any licensing fees, and since both have patents the other is using, this is more or less an issue of going to the table and working out something amicably.
