Notice how innocuous the similarities are compared to the vast difference in the gameplay as outlined in the differences section? That in itself is proof enough that they're different.
If you don't set a limit, everything will be deemed a clone of something when it simply isn't the case. Every fighter even 3D ones would be called a SF fighter simply because you can hit another character with your fists and it does damage to a life bar. It would be a perpetual cycle of stupidity.
