There were fees to license DVD tech and they were higher back then. Different companies owned patents to codecs to play movies, and disc and drive technology. There is a consortium for DVD tech. Nintendo went to Panasonic's parent company Matsushita to develop a proprietary disc format to avoid fees. It's basically the same tech only altered, and they're probably doing the same thing with the WiiU. The WiiU discs are basically proprietary Blu-Ray discs created by Panasonic. Panasonic (Matsushita) owns a lot of the patents on the Blu-Ray "disc" tech while Sony owns a lot on the "drive" (or vice versa.. can't remember) So Panasonic most likely created a proprietary Blue laser disc and a special drive for the Wii U to avoid extra fees.
