There is an issue where people then want to use the courts to order how to divide up property when there is a break up, so it ends up in the government. Also, people want to argue for rights, so they can force employers to provide benefits, require adoption agencies allow them to adopt and so on. End result is that it ends up being the business of the government who marries who.
