Yes it is, but with a difference. The Protean member is one the main standard edition disc as a NPC only, to make it a playable character, it's either with the DLC or the CE.

I don't agree with the move at all, basically because it's a dick move.

In the collectors edition won't they give you a code with cerberus network.

This is what they said.

“DLC has fast [certification] and no [manufacturing]., so if a team works very hard, they can get a DLC done in time to enjoy it with your 1st playthrough on day 1.”


I agree Day 1 DLC is kind of a dick move, but they're doing it because they can. And ultimately a lot, of dev/publishers research what they can get away with to maximize their profits.

 

Well, for all we know, that could be just PR talk to avoid the backlash that this has caused, but it could also be the truth.

Either way, they did the same with the Zaeed DLC on ME2 and it was available for everyone with a new copy of ME2, so I don't see why they went the dick move strategy of putting the From Ashes DLC just for the CE. In any case, Day 1 DLC is simply a money-grabbing scheme, even if it is only a way to maximize their profits, especially since there will be a truckload of DLC coming for ME3 in the future (just look at the history of recent Bioware releases).
