IceFrog isn't THE DOTA guy. he's THE LOUDEST DOTA guy. He didn't create it, he took it over and modified an already existing and successful dota.
Valve shouldn't win, the issue is that Blizzard doesn't think they deserve the trademark. (they don't)
The issue is that Blizzard was perfectly fine with leaving it out and free to be used by others, but now they don't want it locked down by someone who isn't them.
