Nothing Nintendo can really do about it. Games are not copyrightable, only the actually artwork (Textures, models, characters, sounds, etc) They may be skirting the line with the levels, but they have probably been changed sufficiently. The only way Nintendo could sue would be if their art resources were used. Sucks.
