They're the most basic rules of Mafia, and anyone with at least a game under their belt would follow them even if they aren't stated.

Spurge was just a vig that could kill during the day. It's logical that he would not assume it was a night action only.

Just an odd test, or subtest is my take.

I never discouraged those people from talking who talked at night. And I never discouraged mafia talking during the day either. I know they are basic rules, but the rules are the rules.  Don't take argument simply because you're surprised.

I never told spurge he could kill during the day. I said he had a kill. Nothing more. He could kill at night or during the day, but only once. I just never told him when he could.
