Did you actually expect anyone to talk during the day?
If you hadn't stated that dead players can't comment anymore do you think anyone would have chimed in?
They're the most basic rules of Mafia, and anyone with at least a game under their belt would follow them even if they aren't stated.
Spurge was just a vig that could kill during the day. It's logical that he would not assume it was a night action only.
Just an odd test, or subtest is my take.
