No, that would be illegal, so yes you could sue them. They can use the exclusion to have a case dismissed, but the last word will always go to the country's legal system itself. As Kasz said, the exclusion is to discourage more then anything else. In any case, you seem to forget that the exclusion only apply to class action lawsuit not individual civil case.
