From my understanding of it, which is heavily based on the local police policies, Pepper-Spray is only supposed to be used in situations where physical force is justified; and the use is then promoted because pepper-spray is less dangerous than being hit by a police officer.
While there is a small part of me that finds it funny to see protestors with such juvenile attitudes punished by being pepper-sprayed after they are in custody (and it could be a funny bit for the right comedian) it really is no different from a police officer striking an individual who is in custody; and is the sign that this officer should probably never have been an officer, and I think that it might be appropriate to have him face criminal charges.
