Yes it is. As soon as the product is opened it is no longer new. It doesn't matter if the disc is non-scratched. This is why everytime they try to pull that bullshit I laugh at them and walk out of the store.

I would rather shop at Walmart or Amazon anyways. They don't pull this crap, and they're more often then not, cheaper then that rip off retail chain.
