It kinda is used because Gamestop not only takes the pakaging off but they remove the disk from the case. That makes it used, cause to be completely honest, how do you know the game hasn't entered a console? You wouldn't really be able to tell.
Some gamers like me care not only about the disk not having scratches but also the box looking new, they are a package deal. I take pride in taking care of what I own. With EB Games the boxes that they sell as new don't look new and looked used, and sometimes the disk don't look new either. So why would I want to pay the new price when I can buy it used and look exactly like the same product? I know it's weird but meh. The could just as easily put a white sticker on a open used box and call it new and you would never know.
Long story short, stores that sell games (atleast where I live) won't let you return the game once the plastic has been removed. They say once the plastic has been removed they consider it used because that the only way they can know if somebody actually used it (why would you open it and then not use it). So if stores use that moto for their constumers the same should apply to them.
