Umm yes they should be able to sue. They aren't living in a third world country, slave labor isn't condoned here. In Canada I know the law is every two hours your entitled to a fifteen minute break or half an hour every five hours. Your entitled to these breaks for lunch and such. Also employers in Canada can only make you work 8 hour days anymore and it has to be entirely consensual and even then you can only work 13 hours without legality being an issue (Ontario).
So if these guys weren't getting these breaks that would clearly be illegal in Canada. So yes they should sue, if its not law in the US then I think it should be. We are living in North America we should treat each other civilly with dignity and respect. That means giving employees time to eat and go to the washroom.
Heck as a game tester I can't see why staff couldn't eat a bit on the job, I mean your playing a video game its not really a job where you shouldn't be able to have a snack and such.
One employer I worked for actually gave me a two fifteen minute breaks and an hour lunch each day. Worked a nine hour shift opposed to eight but didn't mind much since I got my lunch break and such. Employers need to respect their employees , maybe an hour for lunch is asking a little much but denying them lunch altogether is barbaric.
