Another problem is that while third parties pussyfoot and muddlefuck around, the market is moving without them.
To paraphrase a Churchill quote, they have a choice between shame and supporting Nintendo. I feel that they'll choose shame and have supporting Nintendo thrown in a little later, with worse terms than if they had done it earlier..
