First of all, I couldn't find any proof that the game is actually using voice commands. Furthermore, chances are it doesn't even use Microsoft's skeleton tracking software either, since that causes lag and overhead and is thus unnecessary if a Kinect game doesn't map player movements 1:1 to an on-screen-avatar.
So what's remaining of your reasons is that Kinect is capable of sensing distance. While that's of course true, you don't give any reason why you consider distance information necessary for this game.
