first party companies can made contracts with third party developers to let them publish the games

to be counted as  a first or second party games aka: Ninja Gaiden 2

 And Disney couldn't do this with Nintendo because...? Oh thats right, they could. Publishers do not own the franchise. They get rights to that individual game.
