No. unlocking it to where it can be used for malicious acts is just hacking something really well.
All that matters is when someone does use said unlocked console for malcious acts.
Then the person who specifically does that, gets punished.
If the world worked otherwise, the only videogames we'd be aloud to play would be games like cooking mama.
