so FromSoftware went it alone with their next title but they do NOT steal the IP as it's not called demons souls.

I wouldn't exactly say Sony dropped the ball.  I mean, in hindsight, yeah, the wrong decisions were made, but prior to the game's release, both Sony and From Software had incredibly low expectations as far as the game's commercial success was concerned.  At the time, few would have claimed they were making a bad call. 

Both parties were surprised at how well the game performed long term, and Miyazaki has said the option of doing an actual sequel with Sony is still on the table.

It's not unlikely at all that From Sofware had the intention of doing a sequel before the first game ever appeared to be a success, and when going ahead with that idea, Sony passed on the option of publishing, thus leading to them striking a deal with Namco for Dark Souls' Western release alongside Demon's Souls' European release.
