I think honestly Netflix has many advantages to piracy. Lack of viruses to worry about, no need to store the files on your hard drive, streaming capabilities mean no waiting for a download. But NetFlix is still missing all the latest content. NetFlix needs to get some better contracts for new releases however at the 8$ price tag its going to be alittle hard for them to provide up to date movies. I have a friend who pirates everything that comes to theaters, he then deletes the files after watching and in most cases buys them when they come into store. So price isn't an issue for him, its availibility.
I think if NetFlix could get us new releases faster and in larger quantities then more and more pirates would switch over. But as I said that will not likely happen as content providers can make way more money selling copies then allowing people to stream them for very little profit!
