I am fairly sure I read about his being jailed. I am also fairly sure Guantanamo Bay wasn't where he was sent. I may have just misread.

Cyber attacks carry punishments, especially when they harmed a given entity. In both cases, if the hackers are caught, I am fairly sure they will end up in jail.

That guy wasn't persued by Homeland security. He will be labeled a terrorist, and terrorists don't go to jail.
