In Europe it is. If you advertise it, then you can't remove it, or you have to compensate your users.
Even they used it to import it as a computer, not a videogames system, so they pay less duties.

You just said that it isn't illegal, but it doesn't seem to be that way. Sony hasn't paid anything, yet, but if this jurisprudence extends, it could cost them some money.

not really, people have to have proof of purchase otherwise anyone could just buy a pre-owned ps3 and claim 100 euros and that would be an easy way to get a cheap ps3 at the expense of sony.
im guessing hardly anyone who really cares about other OS will still have their reciepts. most people wont even go for a refund because they dont care and never even used other OS.
