It is not illegal to make backups, but as long as people are willing to abuse backups companies will do evrything to prevent you from playing such a backup.
If they can figure out how to tie a backup to the original is such a way that they can only be used by 1 person at a time, then I'm sure they will sell you all the stuff you could ever want to make as many backups as you like.
They would even prefer a system where a game is uniquely tied to you and can't be used by anyone else. Would you prefer that? It already exists, downloadable games, no resale possibility, but you can backup your hdd as many times as you like. But will you still be able to play them in 10 years?
