A hacker is just another developper, like you and me, at least like me.
What people do with kinect is hacking. That's the right term.
And what GeoHotz does with the PS3 is also hacking.
And there's nothing wrong with it. It's just writing code.
Now if you use this code to use copies of games you did not pay for, then it's illegal.
To make an analogy, sueing Geohot for his work is like sueing Toyota when someone is driving over speed limits. That would not come to your mind, would it?
And I don't even have to say I'm against piracy, and driving too fast. I am.
