Running free apps on a jailbreaked phone isn't illegal, but running pirated apps is.

For example you can run a homebrew or free app solitaire game, but you can't run a pirated vesion of the solataire game in the app store.

Pretty sure this is the case for basically ANYTHING that's a closed system though.  Not just phones. 

Hence why Sony is expected to lose their lawsuit vs Geohot. 

People are free to hack their systems to use whatever firmware or OS they want.

As long as the action is legal... and going against a EULA isn't actually illegal.   Though Sony or whoever it is CAN cut you out of your warranty and refuse to service your products.

I was under the impression that Sony's lawsuit had nothing to do with geohot jailbreaking his PS3 and everything to do with him distributing the root code or whatever it's called.

No.  They're trying to sue EVERYBODY including the people who jailbreaked it but didn't release the specifics.

Eitherway, none of it is actually illegal.  The only way Sony will win is if the Judge doesn't know anything about technology.  Which may be the case.  What with her ordering that the guy has to "retrieve all info he sent out about the hacks in emails."

Which... has the judge ever even used email before?
