Well... Jailbreaking is sort of legal in the US.

It's legal but YOU have to do it.  It's illegal for someone to jailbreak your phone for you.

Which is... silly.

Running free apps on a jailbreaked phone isn't illegal, but running pirated apps is.

For example you can run a homebrew or free app solitaire game, but you can't run a pirated vesion of the solataire game in the app store.

Pretty sure this is the case for basically ANYTHING that's a closed system though.  Not just phones. 

Hence why Sony is expected to lose their lawsuit vs Geohot. 

People are free to hack their systems to use whatever firmware or OS they want.

As long as the action is legal... and going against a EULA isn't actually illegal.   Though Sony or whoever it is CAN cut you out of your warranty and refuse to service your products.
