The illegal part of the propietary software depends on distribution, for example: The use of Windows is by a bought license, so if you get a custom Windows for free is illegal, but if you get a custom Windows 7 Ultimate 64-bit with a lot of mods and you have the Ultimate 64-bit license, you are fine (of course, you can't distribute it to others). Now Sony's official firmware is distributed for free with a terms of use agreement, so if a custom firmware is done for free, it's not illegal as long as the source code is not revealed (that's why there's builders), but it violates the terms of use agreement, so you can get a ban, your warranty removed, and even a civil-suit, but you can't be prosecuted for breaking any laws...
Sony themselves understand that, that's why in the statement they say "Violation of the System Software Licence Agreement for the PlayStation 3 System invalidates the consumer guarantee for that system. In addition, copying or playing pirated software is a violation of International Copyright Laws."
