Retro mainly because they've shown to be competent at making a great game with out Nintendo having to hold their hand through development

Errr, other way around. Not only are all of Retros games Nintendo franchises, but they are financed and co-developed all of them with Nintendo. Rare was much more independent.

Nintendo even had a hand in Rare's own franchises, that mess of a Banjo game they released on 360 was the original concept for Banjo Tooie by Rare's own admission before Nintendo scrapped it, you want an example of Rare's independence then look no futher then Dinosaur Island which went on to become the wayward Zelda lite title Starfox Adventures, heavily delayed with an unimpressive end product. Throughout their time on Nintendo Platforms Nintendo had to consistently step in to fix problems and clear up messes, all of Retro's games have had few members of EAD (most of whom have been composers) compared to the teams who had to keep tabs and help Rare.
