I doubt Sony will win this case, these cases have been brought up before and the manufacturere looses.

The only similar court case involved phone jailbreaking. It was deemed to be ok to jailbreak a phone because it was found that phone companies cannot have a monopoly on a phone outside of a contract. IE: If you buy an Iphone without the 2 year contract, you are allowed to have any phone company you want.

This is a completely different scenario.
