If someone is walking around in your back yard they are tresspassing and god knows why they are there.

That doesn't mean that you can shoot them. Plus, what if it's just your kids playing? Or a friend wanting to surprise you?

Why not, you don't know why somebodies there.  Nobody should be trying to "surprise" you by breaking into your property that's a crime.  That's like saying you shouldn't be able to stop someone from stealing from you because they may just be trying to get you an engraving!
