There is only one way to settle this. Use an Eyetoy in the pitch black (with only the TV on ofcourse). Then do the same with Kinect. That's right, Kinect is the only device where you truly are the controller no matter what the lighting conditions.
If anything, it is Sony who should be sued for false advertising.
