It's a side effect. Tbh I would have personally left it at Jailbreak, so they wouldn't have the reason to poke around further and stumble upon the master code that leaves the whole system open. The hacking of the system has proven to boost HW sales, I don't think that the software sales are effected THAT much seeing as X360 still has a decent attach rate despite being hacked years ago.
Maybe even if thet original hackers didn't intend the hack to be used in such a way(Piracy, Trophy manipulation, ign cheating etc), it's not their fault there are people who are vile enough to pounce upon the slightest of opportunities to exploit the hack, I don't think the whole suing them thing is a good idea, they'll just end up being martyrs to the cause and even more hackers will flood to the PS3 homebrew scene. Unnecessary media attention tbh, but at least now Sony fanboys can't complain about PS3 not getting any marketing x)
