Forget about Apple and Jailbreaking, Sony themselves lost a Jailbreak case in Spain. It is now perfectly legal to own and use a Jailbreak dongle in Spain, and if push comes to shove I can't see Germany (the home country of the majority of the fail0verflow team) and the rest of Europe being any different.

Sony are only persuing legal action in a futile damage limitation exercise to show shareholders that they're attempting to do something about it.

Do they have the equivalent of the European Court of Human Rights in the US..? If, by some miracle, Sony do get a result in Europe with their legal action the fail0verflow team will just appeal in the European Court of Human Rights claiming freedom of expression.
