It would be illegal to do so in certain territories and Sony would end up footing the bill for both replacing the PS3 they criminally damaged and also the costs associated with any lawsuit. Microsoft can brick a console with an update when they ban if they wanted but they never will because as already stated they do not have the right to break your hardware.
