It won't be a launch game.  In fact, I think it could be as late as fall.

Why do you think that? I don't recall reading anything on that and it was the big game they showed off for the 3DS from Nintendo.

I think they showed it off for impact initially.  We already know the four Nintendo launch titles due to a previous retailer leak (Nintendogs/Cats, Pilotwings, Steel Diver, OOT 3D), and Paper Mario's also been hinted for an early release by the Nihon Shimbun (basically Japan's version of the New York and Financial Times)... I just think that pushes Star Fox to spring/summer, Kid Icarus to fall and Mario Kart and Animal Crossing for the holiday.

The other flaw with your list is that Dead or Alive was confirmed launch, at least i'm pretty sure it was
