It is typical tactic to let the product infringing make money first, Sony used dual shock controler for 2 console gens before they were taken to court.

And not once did Sony stop making the PS2 because of the infringement.  So my point is that the 360 will keep being produced and this will be litigated.  Motorola is simply wanting to catch a break on licensing WM7 for their phones.
