Oh man. That's why I admire the UK so much in the judicial aspect due to lacking a core constitution and instead opting only for written guidelines and the like. Myself from instance still own erotic videos and photos from when I was 17 and my girlfriend was 16. I never shared it with anyone. Dammit, it is a part of my life, would it be fair if one went ahead, deleted everything and arrested me because according to a piece of paper I commited a crime?
Every case is a case - can you be aware of everything involved, enter his mind or look at the future and know for sure if something bad ever came or will come from it? So I wouldn't be so early to judge if he commited a crime or not. We can only assume judges and prosecutors will do their best to avail every single case with rationality and commitment and punish those who deserve it and so.
And should countries stick with fixed constitutions, at least make them something decent and not laughable. In my coutrny for instance, should you call a black man 'black' I get instantly arrested without the possibility of a bail. If I instead take my car and run over the black man before he reaches a police station I have the right of a bail as long as a confess I killed him.
