Of course it isn't.

First you don't remove physical copy from someones possession but duplicate virtual item.

Second which comes from first - there's no direct loss but only a loss of potential sale.

 

Hence why all goverments are categorizing it as copyright infigment and not theft.

That is a really good point. Copyright infrigment would be the perfect way to put it,in my opinion. lol
