Oh, and Kasz, the issue is using tools that generate code that's not native, like Flash. If you have a text element, or a button, Apples wants it to be there button, and no some middleware. It's a good idea. Let's say they want to optimize something related to battery life, that requires a button click to register something with the OS. If 25% of your apps don't use your button, you can't implement that kind of thing well.
Something like Monotouch that generates native code, is still legal.
