 No they are not! Not until they have been convicted of such by a court. It is called the presumption of innocence and is a human right which means that by presuming them guilty the US are violating these men's human rights:

 

• The Universal Declaration of Human Rights, article 11, states: Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which they have had all the guarantees necessary for their defence.

Using presumption of guilt is one of the first steps to a totalitarian society as it allows to imprison anybody on bogus charges that are very hard to disprove (especially once you have been arrested and denied legal counsel).

The next US election cannot come soon enough and we can only hope that the next US government won't be as bad as the current one.

P.S.: If you think that the war in Iraq is expensive wait until you have to pay reparations to all those that have been illegally detained and tortured or their family in the coming decades; that should add quite a bit to the cost.
