If DigitalFoundry is right, that's actually not a hack. Someone stole/got a program (or code, have no idea) to run the PS3 as a debug unit, the same way devs have. The HDD backup is available for developers, plus they can run unsigned code. That's (probably) how these guys are running games from the HDD.
A simple software update plus new codes for developers would effectively cut out this "hack". new games would have this update and Sony forces some mandatory updates for online gaming, which would remove that code from these guys.
Feel free to correct me, as I understand just a little of this stuff.
