Xbox advert criticised by advertising watchdog for using Playstation images to promote game

Not to make this an xbox issue, but didn't MS pay for all the advertising of ff13?

Also, I'm wondering what will happen to MS if they show their Kinect commercials without lag using choeorgaphed actors.
